Personal Web Page Agreement

 

This Agreement made effective this _____ day of _____ , 199__ is between the University of Miami (the University) and the author of the University Personal World Wide Web Page who has signed at the end of this Agreement (User). If User is an organization, the organization shall designate an individual to be responsible for the format of the personal Web pages; and that person shall sign this agreement.

Recitals

The personal Web pages served by the University personal server are accessible by Internet users around the world and are subject to all local, state, federal, and international law, as well as University policy.

It is necessary to distinguish between the official University Web pages, which represent the University, and personal Web pages, which may contain individual opinion and other content not related to the University.

For those and other reasons, it is important that the obligations of both the User and the University be clearly understood. Therefore, the University and the User, whose signature appears below, agree to the following:

Terms and Conditions

  1. The University shall provide personal Web pages services to User pursuant to the policies and procedures of the University including but not limited to the University of Miami's World Wide Web Policies <http://www.miami.edu/web/policies.html> (in particular the sections relating to Policies for Content and Policies for Personal Web Pages), the University of Miami Policies and Procedures Manual <http://www.miami.edu/CompSec/policies.htm>, the terms and conditions of this Agreement, and any other applicable policies that the University may designate in its sole discretion.
  2. User understands and agrees that the University's computer resources, including but not limited to the personal Web server and network, are provided to User as a privilege, not a right. The University may limit the amount of space that is provided on the server.
  3. Links from official University Web pages to personal Web pages for students will be included only from the University's directory for personal Web pages (accessed via the Directories option on the Tool Bar) and/or a personal Web page directory maintained by the student's school or department. Personal Web pages for faculty and staff (but not for students) may also be accessed via embedded links on official Web pages as well as from personal Web page directories.
  4. All contents of the personal Web pages of User shall be the sole responsibility of User, and the User will indemnify and hold harmless the University from any claims arising therefrom. The following disclaimer must appear explicitly (not just via a link) on each personal Web page that is stored on a server connected to the University network:

"This personal Web page is not an official University of Miami Web page. See disclaimer."

  • where the link for "See disclaimer" should point to <http://www.miami.edu/web/disclaimers/further-personal.html>. User's E-mail address shall be displayed on each personal Web page.
    1. The content of User's personal pages must adhere to the University Policies and any and all applicable local, state, or federal laws. All personal Web pages must comply with the "Policies Relating to Personal Web Pages," "Policies Relating to Web Page Content," University policies relating to computer use (Finance sections F040, F045, and F046 of the University of Miami Policies and Procedures Manual, which deal with software copyright protection, computer access and confidentiality, and use of computer systems and networks, respectively), and any relevant department, school, or college policies. Individuals must not publish any information about others that might violate the Family Educational Rights and Privacy Act or any other law that pertains to dissemination of information that would apply to the University. User's signature below verifies that the User has read and agreed to the terms and conditions of those policies.
    2. No personal Web pages may contain advertising or direct links to advertising for commercial advantage.
    3. The appearance of personal Web pages must differ substantially from that of official Web pages. Furthermore, personal Web pages must not include the University of Miami logo.
    4. User's personal Web pages shall reside only on the University's personal Web server, on a personal Web page directory maintained by a school or department, or on that User's personal computer. All personal Web pages for faculty, staff, and/or students that are stored on any server connected to the University network must contain "/personal/" as part of the URL.
    5. System administrators who are responsible for servers containing "personal" directories are authorized to remove any and all personal Web pages of faculty and staff whose employment has been terminated. Such Web pages will be removed within a year of termination. Personal Web pages for students will be reviewed when the student graduates, permanently withdraws, or is not enrolled for two consecutive semesters (excluding official leaves of absence).
    6. Any violation by User of the terms and conditions of this Agreement or any applicable University Policies may result in the imposition of sanctions, including those stated in the University Policies and/or revocation of the privilege granted by the University in this Agreement.

    By signing below I acknowledge that I have read this Agreement and the University of Miami's World Wide Web Policies <http://www.miami.edu/web/policies.html>, including its Policies for Content and for Personal Web Pages. I understand and agree that I must abide by the terms of this Agreement, the World Wide Web Policies, all applicable University of Miami Policies and Procedures, and any and all local, state, or federal laws. I understand and agree that the University may at any time in its sole discretion, limit or deny access, shut down or remove my web page from its server. I acknowledge and I agree that if any of my activities violate or may potentially violate, in the sole opinion of the University, any applicable laws or policies, this privilege granted to me may be revoked and sanctions as outlined in those applicable laws and policies may be imposed as necessary.
